The Alabama State Supreme Court ruled Friday that construction for a new bridge into the area may continue construction. The further stated that a lower court did not have the authority to halt the construction of a two-lane bridge in Gulf Shores, and reversed a preliminary injunction against the project.

The court's ruling said that the Alabama Department of Transportation and its Director are protected by the “Doctrine of State Immunity” in the Alabama State Constitution, which gives the states and its agencies “absolute immunity” from being sued.
The decision reverses a May ruling by Montgomery Circuit Judge Jimmie Pool, who ordered the bridge project halted following a seven-day bench trial that included 13 witnesses and over 200 exhibits.

Scott Bridge Company had asked to be added back to the case to recoup damages from the injunction bond. However, since the lower court dismissed it from the case, the company will not be entitled to the protection of an injunction bond. Therefore, the $100,000 limit from the injunction bond appears to be the capped amount they will receive for the time the construction was ceased.
